የትምባሆ ምርትን ማስወገድ የሰዉ እና የእንስሳ ጤናን በማይጎዳ እንዲሁም አካባቢን በማይበክል ዘዴ እና ስርዓት መከናዎኑ አስፈላጊ በመሆኑ፤ መወገድ ያለበትን የትምባሆ ምርትን በመለየት፣ ማከማቸት፣ማጓጓዝ እና ማስወገድ ሂደት በሚፈጠር የቁጥጥር ክፍተት ምርቱ እንደገና ወደ አቅርቦት ሰንሰለት በመግባት መልሶ ጥቅም ላይ እንዳይዉል እና በህበረተሰብ ጤና ላይ ጉዳት እንዳያስከትል መከላከል በማስፈለጉ፤

በምግብ እና መድሃኒት አስተዳደር አዋጅ ቁጥር 1112/2011 አንቀጽ 4(4)፣ 4(17)፣ 65(5) እና 68(2) መሠረት በአዋጁ ወይም በሌሎች ህጎች መሠረት ማሟላት ያለበትን ያላሟላ ምርት ወይም የአገልግሎት ጊዜዉ ያለፈበት፣ ህገወጥ ምርት ወይም አገልግሎት ላይ የማይዉል ምርት ወይም ተፈጻሚነት ያላቸውን የቁጥጥር መስፈርቶች በመጣስ የቀረበ ምርት በሰው እና በእንስሳት እንዲሁም በአካባቢ ላይ ጉዳት በማያደርስና በአግባቡ መወገድ እንዳለበት እና ባለስልጣኑ መወገዱን የመቆጣጣር ኃላፊነት የተጣለበት በመሆኑ፤

የኢትዮጵያ የምግብ እና የመድሐኒት ባለሥልጣን በምግብ እና መድሃኒት አስተዳደር አዋጅ ቁጥር 1112/2011 አንቀጽ 71(2) መሠረት ይህ መመሪያ ወጥቷል።

Whereas it is important that the disposal of tobacco products shall be carried out in a manner and system that does not harm human and animal health and does not pollute the environment;

Whereas it is important to prevent the product from re-entering the supply chain and being reused and causing harm to public health due to a regulatory gap that may arise in the process of identifying, storing, transporting and disposing of tobacco products;

Whereas the Food and Drug Administration Proclamation No. 1112/2019 Article 4(4), 4(17), 65(5) and 68(2) stipulates that products that do not meet the requirements of the proclamation or other laws, expired products or illegal products or product supplied in violation of the applicable regulatory requirements shall be properly disposed of without causing harm to humans, animals, and the environment, and the authority has been assigned the responsibility of overseeing its disposal;
