በሲቪል ማኅበረሰብ ድርጅቶች አዋጅ ቁጥር 1113/2011 አንቀጽ 63 ንዑስ አንቀጽ (1)(ለ) በገቢ ማስገኛ ስራዎች ላይ የሚሰማራ ድርጅት፣ አግባብነት ባላቸው የንግድ ፈቃድና ምዝገባ ህጎች መሠረት፣ አዲስ የንግድ ድርጅቶችን (ኩባንያዎችን) በማቋቋም፣ በነባር የንግድ ድርጅቶች ውስጥ አክሲዮን በመያዝ፣ ህዝባዊ መዋጮ መሰብሰብ፣ ወይም የንግድ ስራን በብቸኛ ባለቤትነት በማካሔድ የገቢ ማስገኛ ስራዎችን ማከናወን እንደሚችሉ የተደነገገ በመሆኑ፤

በአዋጅ አንቀጽ 5 ንዑስ አንቀጽ (2) የሲቪል ማኅረሰብ ድርጅቶች በተመዘገቡበት ዓላማ መሠረት ሥራቸውን ማከናወናቸውን በመከታተልና በመቆጣጠር የሕብረተሰቡን የላቀ ተጠቃሚነት ማረጋገጥ ከባለስልጣኑ ዓላዎች ውስጥ አንዱ ሆኖ በመደንገጉ፤

በአዋጅ አንቀጽ 6 ንዑስ አንቀጽ (10) ድርጅቶች የሚያከናውኗቸው የልማት ሥራዎች መንግሥት ከሚያወጣቸው የልማት ዕቅዶች ጋር የተጣጣሙ እንዲሆኑ የሚያግዙ የፖሊሲ መመሪያዎችን ማዘጋጀት እንደሁም በንዑስ አንቀጽ 16 በዘርፉ በወንጀል ድርጊት የተገኘ ገንዘብ ወይም ንብረትን ሕጋዊ አስመስሎ ማቅረብና ሽብርተኝነትን በገንዘብ መርዳትን ለመከላከል የሚያስችሉ ሥራዎችን ከሚመለከታቸው የመንግሥት አካላት ጋር በትብብር የመሥራት ሥልጣንና ተግባር የተሰጠው በመሆኑ፤

የሲቪል ማኅበረሰብ ድርጅት የተጠቃሚዎችንና የአባላትን ጥቅም በላቀና ግልጽነትን በተላበሰ ሁኔታ ማከናወን የሚችሉበትን ሁኔታ ማመቻቸት አስፈላጊ ሆኖ በመገኘቱ፧

ከላይ የተጠቀሱትን የአዋጁን ድንጋጌዎች እና የሲቪል ማኀበረሰብ ድርጅቶች ደንብ ለማስፈጸም የሚያስችሉትን መመሪያዎች ማውጣት አስፈላጊ ሆኖ በመገኘቱ፤

የሲቪል ማኅበረሰብ ድርጅቶች ባለሥልጣን በአዋጁ አንቀጽ 89 ንዑስ አንቀጽ (2) በተሰጠው ሥልጣን መሠረት ይህን መመሪያ አውጥቷል፡፡

WHEREAS, it is stipulated under Article 63(1)(b) of Civil Society Organizations Proclamation No. 1113/2019 that an organization engaged in income-generating activities, in accordance with the relevant business license and registration laws, may carry out income-generating activities by establishing new businesses (companies), holding shares in existing businesses, collecting public contributions, or conducting business as a sole proprietorship;

WHEREAS, it is provided that one of the objectives of the Authority is to ensure the greater benefit of the society by monitoring and controlling the activities of civil society organizations according to the purpose for which they are registered under Article 5(2) of the Proclamation;

WHEREAS, the Authority has the powers and functions vested in it by Article 6(10) of the Proclamation to issue policy guidelines that help the development activities carried out by organizations be prepared in line with the development plans issued by the government, as well as to work in cooperation with the relevant government bodies to prevent the legalization of money or property obtained through criminal activity in the sector, and to prevent the financing of terrorism as stipulated under paragraph 16;

WHEREAS, it is found necessary to facilitate the situation in which the civil community organization can carry out the interests of beneficiaries and members in a better and more transparent manner;

WHEREAS, it is found necessary to issue a directive to enforce the above-mentioned provisions of the Proclamation and the regulation of civil society organizations;

NOW THEREFORE, the Civil Society Organizations Authority has issued this Directive pursuant to the powers vested in it by Article 89(2) of the Proclamation.
