የሀገራችን የግንባታ ስራ ተቋራጮች ሥራ አፈጻጸም በፋይናንስ፣ በሚያሳትፉት የሰው ኃይል ተገቢነት፣ ከቴክኖሎጂ፣ ከአመራርብቃት፣ ከአሰሪዎች ተለዋዋጭ ፍላጎት እንዲሁን ሌሎች ከጨረታ ግዢ ጋር በተያዙ ችግሮች አብዛኛው የመንግሥት. የግንባታ ፕሮጀክቶች በተዋዋለበት ጊዜ፣ ወጪ እና ጥራት መከናወን ካለመቻላቸውም በላይ በግንባታ ሂደት ከፍተኛ ብክነትና የፕሮጀክቶች ወጪ ጭማሪ እያስከተለ በመሆኑ፤

አነስተኛ ቁጥር ያላቸው የኮንስትራክሽን ሥራ ተቋራጮች በርካታ የግንባታ ፕሮጀክቶች ከግብዓት ዋጋ በታች በዝቅተኛ የመጨረቻ ዋጋ የሚያሽንፉ በመሆኑ የገበያውን ሁኔታ ከማወካቸውም በላይከፍተኛ የሥራ መደራረብ፣ የመፈፀም አቅም ውስንነት እንዲሁም የግንባታ መጓተትና የጥራት መጓደል እያጋጠመ በመሆኑ፤ እና ሌሎች ብቃት ያላቸውን የሥራ ተቋራጮች ከውድድር ከማስወጣቱም በላይ ቅድመ ክፍያ ወስዶ መሰወርና የወሰደውን ቅድመ ክፍያ ከፕሮጀክቱ ውጪ ለሌላ ዓላማ ማዋል፣ በአሰሪና በሥራ ተቋራጭ መካከል አለመግባባት እስከ ውል ማቋረጥ የሚደርስ ችግር ማየት የተለመደ ክስተት በመሆኑ

በኮንስትራክሽን ኢንዱስትሪ ብልሹ አሠራርበማስወገድ መሠረታዊ ለውጥ ለማምጣት እንዲቻል ግልጸኝነትና ተጠያቂነት ያለው የአሠራር ሥርዓት ዘርግቶ ኢንዱስትሪው በጠንካራ አመራር መምራት ለዚህም የተመቻቸ የሕግ ማዕቀፍ ማዘጋጀትና በስራ ላይ ያሉትንም ወቅቱን ጠብቆ ማሻሻል በማስፈለጉ፤

በመሆኑም በኢትዮጵያ ፌደራላዊ መንግሥት አስፈጻሚ አካላትን ሥልጣን እና ተግባር ለመወሰን በወጣው አዋጅ ቁጥር1263/2014 አንቀጽ 19(4) በተሰጠው ሥልጣን መሠረት የከተማና መሠረተ-ልማት ሚኒስቴርም ይህን የግንባታ ሥራ ተቋራጮች የፕሮጀክት አፈጻጸም ምዘና መመሪያ አውጥቷል፡፡

WHEREAS, the performance of our Country’s construction contractors has been hampered by financial, manpower, technology, managerial, labor demand and other issues related to bidding and procurement, most government construction projects are not performed timly, with costs and quality usually leading for significant waste and inhanced project costs;

WHEREAS, small number of construction contractors win bid with ureasonably low market price causing | to disrupt the market conditions and construction delays and poor quality works; likewise, it is not uncommon for other qualified contractors to be excluded from the competition and to take pre-payment and use the proceeds for purposes other than the project, leading to disagreements between the employer and the contractor leading to termination of the contract;

WHEREAS, it is found necessary to alleviate the performance constraints of construction contractors, and to bring about a fundamental change in the construction industry and to lead the industry with strong leadership, create a conducive legal framework and improve the existing ones and establish a transparent and accountable system that can eliminate mal-practices;

NOW, THEREFORE, in accordance with the authority given in Article 19(4) of Proclamation No. 1263/2014, the powers and functions of the executive bodies of the Federal Government of | Ethiopia, it is hereby the Ministry of Urban and Infrastructure Development has issued the Contractors Construction project performance evaluation directive as follows:
